This Privacy Policy describes how we collect, use, maintain, protect, and disclose information when you visit pickleball365franchise.net (the “Website”) or interact with us in connection with our franchise sales activities.
This Website is operated by Pickleball 365 Franchising, LLC, a Delaware limited liability company, for the purpose of providing information about Pickleball 365 franchise opportunities to prospective franchisees. It is separate from the consumer-facing club website operated by our affiliate Pickleball 365, Inc. at pickleball365.net, which has its own privacy policy.
This policy applies to information gathered:
- On the Website
- Via email, text, telephone, and other electronic messages
- Through forms you complete on the Website (including franchise inquiry forms, FDD requests, and qualification questionnaires)
- Through third-party marketing, lead-generation, and advertising platforms we use
It does not cover information collected offline through unrelated business activities, through other websites operated by our affiliates (including pickleball365.net), or by third parties whose practices we do not control.
Not Intended for Consumers or Minors
This Website is intended for adults aged 18 or older who are evaluating a Pickleball 365 franchise opportunity. It is not intended for consumers seeking to use Pickleball 365 club services, and it is not intended for individuals under 18. We do not knowingly collect personal information from individuals under 18. If you believe we may have inadvertently collected such information, please contact us at franchising@pickleball365.net.
Information We Collect
We collect the following categories of information from individuals who visit the Website or submit franchise inquiries.
A. Information you provide directly
- Contact information: name, email address, telephone number, mailing address, business address
- Background information: employment history, current occupation, prior business ownership experience
- Financial qualifications: net worth, liquid capital, source of funds, financing intentions
- Geographic interest: states or markets where you may want to develop a Pickleball 365 Center
- Timeline: when you intend to invest and when you intend to open
- Correspondence: emails, text messages, calls, voicemails, meeting notes, FDD requests, and post-disclosure questionnaire responses
- Receipts: your signed acknowledgment of FDD receipt (required by FTC Rule Item 23)
B. Information collected automatically
- IP address, browser type, operating system, device identifiers, referring URL, pages visited, and time and duration of visits
- Approximate geolocation derived from IP address
- Cookies, web beacons, pixel tags, and similar tracking technologies (see “Cookies and Tracking” below)

How We Use Information

- Evaluate your qualifications as a prospective franchisee
- Send you our Franchise Disclosure Document (FDD) and supporting materials
- Comply with the FTC Franchise Rule’s 14-day pre-sale disclosure requirement and maintain the FDD receipt log required by Item 23
- Comply with state franchise registration, filing, and pre-sale disclosure requirements in jurisdictions where we are registered or filed
- Communicate with you about the franchise opportunity, schedule discovery calls, host validation calls with existing franchisees, and arrange “Discovery Day” visits
- Tailor marketing communications to your interests, including via email, phone, text, social media, and digital advertising
- Detect, prevent, and respond to fraud, security incidents, and violations of our Terms of Use
- Comply with court orders, subpoenas, regulatory inquiries (including from the Federal Trade Commission and state franchise administrators), and our legal obligations
- Enforce our agreements
Information We Share
We may share your information with:
- Our affiliates, including Pickleball 365 Holdings, LLC and Pickleball 365, Inc.
- Franchise counsel and other legal advisors
- Our CPA, financial advisors, and other professional service providers
- Franchise brokers and consultants we engage in the franchise sales process (whose involvement, where applicable, will be disclosed to you in writing in accordance with NASAA’s 2023 Statement of Policy on Franchise Brokers)
- Lead-routing, CRM, email-marketing, and marketing-automation service providers
- Hosting providers, analytics providers, and other technology vendors that support our Website operations
- Other prospective franchisees, but only with your express permission (for example, during validation calls)
- State franchise administrators in jurisdictions where we are registered or file notice, when required
- The Federal Trade Commission, if required
- A successor or acquirer in the event of a merger, sale, restructuring, financing, or asset transfer involving Pickleball 365 Franchising, LLC or our affiliates
- Courts, law enforcement, or other parties when required by law or when we reasonably believe disclosure is necessary to protect our rights, customers, or the public
We do not sell your personal information to third parties for monetary consideration. The exchange of personal information with the third parties listed above is for the purpose of operating our franchise sales activity, not for sale.
Mobile Information and Text Messaging
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Cookies and Tracking

California Privacy Rights
Under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), California residents have the right to:

- Request access to and a copy of the personal information we hold about you
- Request deletion of the personal information we hold, subject to legal exceptions
- Correct inaccurate personal information
- Opt-out of the “sale” or “sharing” of personal information for cross-context behavioral advertising
- Limit the use of sensitive personal information
- Not be discriminated against for exercising any of these rights
We do not sell personal information for monetary consideration. However, because some of our advertising involves “sharing” for cross-context behavioral advertising as defined under California law, California residents may opt out by emailing franchising@pickleball365.net with “California Privacy Request” in the subject line. We will respond within 45 days.
California residents may also request information about disclosures of personal information to third parties for direct marketing purposes under California Civil Code §1798.83 (“Shine the Light”).
Other State Privacy Rights
Residents of states with comprehensive consumer privacy laws — including Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), Montana (MCDPA), Iowa (ICDPA), Delaware (DPDPA), Tennessee (TIPA), Indiana (ICDPA), New Hampshire, New Jersey, Minnesota, Maryland, Rhode Island, and Kentucky — may have rights to access, correct, delete, port, or opt out of certain processing of their personal information. Residents of the European Economic Area and United Kingdom
The Website is not directed to residents of the EEA or UK, and we do not actively market the franchise opportunity to EU/UK residents. If you are an EEA or UK resident and you choose to provide us information, you have rights under the GDPR/UK GDPR including access, rectification, erasure, restriction, portability, and objection. Data Retention
We retain franchise lead information for as long as you are actively engaged in the franchise evaluation process plus a reasonable period thereafter for our records, subject to deletion requests permitted under applicable law.
We retain FDD receipt acknowledgments (Item 23 receipts), signed agreements, and related franchise sales records for the period required by the FTC Franchise Rule and applicable state franchise laws — typically the longest of: (i) three years after the franchise relationship ends, (ii) the period required by the franchise administrator in each registration state, and (iii) any longer period required by applicable record-retention laws.
Data Security
We implement reasonable administrative, technical, and physical safeguards to protect the personal information we collect. However, no system is fully secure. You acknowledge that the transmission of information over the internet is not entirely secure and that we cannot guarantee the security of information you submit through the Website.
Changes to This Policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be announced on the Website’s home page or by email to individuals on our franchise mailing list. Your continued use of the Website following any change constitutes acceptance of the updated policy.
